Step 2: Sealing or Expunging?

Understanding whether your situation is suited for record sealing or expunging is crucial. We will help you decide based on your unique factual circumstances.

Step 3: Expungement of Record Sealing Packet

We'll assist you in completing and filing the necessary paperwork for your expungement or sealing application, ensuring every detail is accurate and in compliance with Florida law.

We begin your case by immediately creating an expungement or sealing packet specific to your case(s) according to Florida's legal requirement and follow up by sending you the packet along with instructions via email on how to complete the packet.

Step 4: Submission to State Attorney’s Office and FDLE

Once we receive your fully completed expungement or record sealing packet, we submit it to the relevant State Attorney’s Office and FDLE for approval. 

Should a "Certificate of Eligibility" be issued, we proceed with preparing your Petition to expunge or seal motion set.

Step 5: File the Petition to Expunge with Court

We file the Petition Expunge or Seal motion set together with the FDLE Certificate of Eligibility with the appropriate Court where the incident was adjudicated.

We make sure to send copies to the appropriate State Attorney's Office and Arresting Agency pursuant to Florida Rules of Criminal Procedure 3.692.

Step 6: State Attorney's Response

The State Attorney will consider your petition and determine whether or not to object (this happens on a case by case basis). If there is an objection, a court hearing will be needed as it then becomes a contested expungement or sealing matter. This could be a mini trial of its own kind. If no objection is announced however, then depending on the judge that is assigned to the case, a court hearing might still be necessary to put the matter before the record. Should the judge grant the petition, the Clerk of the Court must process the expungement or record sealing of the criminal history record.
